PGA – TSCA Declaration – EP7 on HTS
Under the Toxic Substances Control Act (TSCA), EPA has the authority to regulate the manufacture (including import), processing, use, distribution in commerce, and disposal of chemical substances and mixtures that present, or will present, an unreasonable risk to human health or the environment. Importers of chemicals in bulk or as part of mixtures are required to certify that their imported chemicals or mixtures are either in compliance with TSCA or not subject to TSCA.
TSCA Certification can be used to declare the positive or negative TSCA Certification Statement. The Certification Statements are as follows:
- Positive(EP4) – I certify that all chemical substances in this shipment comply with all applicable rules or orders under TSCA and that I am not offering a chemical substance for entry in violation of TSCA or any applicable rule or order under TSCA.
- Negative(EP5) – I certify that all chemicals in this shipment are not subject to TSCA.
To declare EPA – TSCA, you must click on PGA button, on Cargo Screen. (All PGAs must be declared prior to Cargo Certification).
On PGA screen you need to select an EPA Agency Program (TS1/TS1)
If you Disclaim TSCA Declaration, select one of 5 options, no need any other information.
To Declare TSCA, you need to fill a Record for Declaration Code(PG 22). Select one of the (EP4-Positive/EP5-Negative) TSCA Certifications.
Last requirement is a Point of Contact for TSCA Declaration(PG21). Qualifier is always CI – Certifying Individual, Name, phone and e-mail are required. Click on return to save record.
